EPISODE 1: How East Malaysia and Terengganu were robbed of their wealth

THE CORRIDORS OF POWER

Raja Petra Kamarudin

Give or take, give and take, they are both four letter words, just as Umno is (pun intended). Nevertheless, we can expect Umno to be confused about when to use the word ‘give’ and when to use ‘take’. However, Pakatan Rakyat too?

As Julius Caesar said, “Et tu Brute?”

I am talking about the 5% Oil Royalty ‘given’ to Sabah and Sarawak (and, of course, to Terengganu -- as to all the other states as well: in the event that they too have oil and gas).

Yes, both Barisan Nasional and Pakatan Rakyat are currently discussing how much Oil Royalty should be ‘given’ to those states that have oil and gas. How do you ‘give’ them something that already belongs to them in the first place? Should not the word we use be ‘take’? We should instead be discussing how much we should ‘take’ from them, not how much we should ‘give’ them.

Let me explain the history of this entire thing.

The oil and gas already belongs to the states. This is what the Malaysian Agreement and the earlier Federation Agreement was all about. And, in that Agreement, it was agreed that all natural resources would be the property of the states.

No doubt, some things such as defence, security, foreign policy, etc., were federalised. But religion and natural resources are supposed to be the prerogative and property of the states.

Water, timber, land, sand, minerals, etc., all belong to the states. As do oil and gas. These are what we call natural resources. Hence they belong 100% to the states, not 5% or 20% or 50% or whatever.

Now, Umno is, of course, misleading us. They are talking as if all natural resources, except oil and gas, belong to the states and that oil and gas belong to the federal government. That is not true. And to suggest otherwise is a violation of the Malaysian Agreement. And I would expect better from the opposition. Why is the opposition sounding like Barisan Nasional and talking about how much Oil Royalty to ‘give’ to the states?

Oil was first rumoured to have been discovered in Terengganu even before 1972, during the time when Dato' Nik Hassan bin Wan Abdul Rahman was the Menteri Besar of Terengganu and Tun Abdul Razak Dato' Hussein the Prime Minister of Malaysia. And I said rumoured because the discovery of oil was never officially announced but was something that was being whispered in the corridors of power.

Why the hush-hush? Well, because the government had to first sort out some ‘loose ends’ before announcing the discovery of oil. So they did not want anyone to know about it until the federal government could ensure that the oil was ‘transferred’ to the federal government. If not, 100% of the oil revenue would go to the state of Terengganu.

In the meantime, they secretly sold the oil to foreign buyers. The oil was transferred from the oil rigs to the ships in the middle of the sea and was exported. Only some people knew about it, the Petronas officers being some of those people.

Lim Kit Siang came to find out about this secret arrangement and there was a hue and cry when he revealed that the oil was being stolen from Terengganu. It seems a Deep Throat in Petronas had told him about it. Exxon, in collaboration with Petronas, were fingered as the chief conspirators.

A crisis was about to explode. There were rumours that all the documents in the Exxon office in Kuala Lumpur suddenly disappeared and reappeared in Singapore the following day. Then, suddenly, the whole thing mysteriously died down and nothing more was said about the matter. No denial or rebuttal was ever issued.

Soon after that, the Menteri Besar went into conflict with the Sultan and was forced to resign. He was also exiled from Terengganu and was not allowed to ever set foot on Terengganu soil again as long as the Sultan was still alive. He never returned to Terengganu until the Sultan died.

The tense moment in that entire episode was when the Sultan’s brother stormed into the Menteri Besar’s office and pointed a gun at the Menteri Besar’s head. The Sultan’s brother too was exiled to Pahang and only returned to Terengganu to attend the Sultan’s funeral.
Meanwhile, Tun Razak came out with a plan on how to bring PAS into the federal government. PAS had to be neutralised if the federal government wanted to grab Terengganu’s oil. The idea to form Barisan Nasional was mooted and all the opposition parties such as PAS, PPP, Gerakan, etc., were invited to join Barisan Nasional.

In 1973, Barisan Nasional was launched and PAS became part of the federal government. In 1974, the new ruling coalition in Parliament (where all the opposition parties except DAP were now members of) passed the Petroleum Development Act and the oil and gas were transferred from the states to the federal government, meaning Petronas.

To keep the states quiet, they were given 5% as a token ‘Oil Royalty’.

This was like the whites taking away the Native American lands (then called Red Indians) by giving them worthless beads as payment.

Now, if the federal government had power over oil and gas, why the need to pass the Petroleum Development Act in Parliament? Just take it! But they couldn’t just take it. Oil and gas are the property of the states. So they needed to pass an Act of Parliament to legalise the illegal takeover of state property.

There was of course some resistance to this move, in particular from Sabah. But all resistance was silenced when the dissenters died in a mysterious plane crash that has never been properly explained until today.

Pakatan Rakyat should stop talking about how much Oil Royalty to ‘give’ the states and whether it should be increased from the current 5% to 20% or 50% or whatever. That is Barisan Nasional type of talk.

The federal government is actually taking what belongs to the states. Therefore, you should be talking about how much you should take: whether 95% like now, or whether you reduce what you take down to 80% or 50%.

If we go by the spirit of the Federation Agreement, then you should take nothing. You should return 100% to the states. The most you can do is to levy a tax, like the timber export tax, palm oil tax, etc. That is all the federal government can earn. Even if the tax is 35% or 45% never mind. But it has to be a tax on the profit of the sales or a form of export tax or sales tax, whether you make a profit on the sale or not.

We always talk about Rule of Law and not Rule by Law. The Petroleum Development Act is a classic example of Rule by Law. They passed a law to legalise something illegal: meaning, nationalising state property.

We must now correct this injustice and call a spade a spade. The federal government has been robbing the states of their oil for the last 40 years and has been giving them a mere 5% of the proceeds when it should be 100%. That is the reality of the situation.

Lim Kit Siang of DAP knows about this. He was the one who revealed what was going on even before most people knew that oil was being extracted from Terengganu. And Tun Salleh Abas of PAS also knows about this. He was the ‘architect’ who drafted the Petroleum Development Act. So no more talk about how much to give the states. We must now talk about what we are taking from the states.

Free Sabah from Malaya’s Domination and Occupation - Dr. Jeffrey

Kota Kinabalu:    “The formation of Malaysia as a partnership through the merger of 4 sovereign entities is meaningless if Sabah continues to be occupied and dominated by the over-presence of Malayan government officers and federal government agencies” said Datuk Dr Jeffrey Kitingan, Chairman of BHF in his Malaysia Day message at the Batu Sumpah, Keningau.

Dr. Jeffrey who is also the Bingkor Assemblyman said that their over-presence and overbearing dominance of the federal ministries, departments and agencies showed that Sabah is just a “colony” of Malaya in the name of the federal government.

Sabah is slowly becoming a Malay unitary state of Malaya.

“Where is the partnership that we have been promised at the time of the formation of Malaysia” asked Dr. Jeffrey.

“What happened to the recommendation of the Cobbold Commision’s Chairman, Lord Cobbold, who said:-

“It is a necessary condition that, from the outset, Malaysia should be regarded by all concerned, as an association of partners, combining in the common to create a new nation but retaining their own individualities.”

“If any idea was to take root that Malaysia would involve a ‘take over’ of the Borneo territories by the Federation of Malaya and the submersion of the individualities of North Borneo and Sarawak, Malaysia would not, in my judgment, be generally acceptable or successful.”

Malaysia, Jeffrey said, has now clearly become Malaya’s “takeover” project  -  takeover of our political power (through Umno), takeover of our oil resources, our tax revenues and our legitimate role and share of the federal government.

They have also robbed us of our independence, re-engineered our population and our political franchise given to illegal immigrants, even our rights to visit and honour our Oath Stone, Batu Sumpah, has been denied from us.

“Do not brand us as trouble makers when we question what is wrong”.

Leaders in the federal and Sabah governments should put things right lest the future of Malaysia will be exactly what Lord Cobbold said “a failure” and “not acceptable”.

Sarawak may leave Malaysia sooner than expected

Written by: Dr. John Brian Anthony

Federal Government proposed to have 1 additional Army Division in Sabah and additional Brigade strength for Sarawak. What is the meaning and implication of this proposal? Is the Federal Gov’t worried about the rising sentiment in Sarawak to get out of Malaysia?   Sarawakian feel than Kuala Lumpur is colonizing the State in every sense of the word.

Sarawak against the British colony

Just the other day I had discussion with some friends who wanted to know whether Sarawak is serious about getting out of Malaysia as seen in many blogs and Face Book discussion.  Frankly, Sarawakian felt colonize by Malaya today. From History, Sarawak responded negatively towards Britain when Sarawak was a colony that one of Sarawak son killed the British Government by plunging a knife into the gentlemen while inspecting a parade given in honour of the Governor’s visit. The British Governor subsequently died.

Prior to being made a colony under British rule many Dayak War Chiefs fought wars with the Brookes. Of all the War chiefs, Rentap was the most famous for being able to defeat the Brooke army twice and made his last stance at Bukit Sadok.

Is Sarawak a colony of Malaya?

If you look at the Federal Government policies and their approach towards taking Sarawak natural resources wealth and also the way Sarawak is being develop at snail pace into the “3rd poorest state in Malaysia”, these are evident enough. In the Federal civil service, Federal Government make sure that the top post are held by their people which is against the Borneonization of the Civil Service.

Politically, Sarawak reject UMNO at all cost so as not to put the last nail into the Sarawak coffin of being made a colony of Malaya.

Taib’s response to Prime Minister political pressure

In the recent election in April 2012, Taib Mahmud has to demand that the Governor swore him to be the next Chief Minister of Sarawak on the evening that the State election result was announced. Taib was not ready to be replaced as the chief Minister as demanded by Najib. Actually, before the election Taib “commit” to step down as Chief Minister after 2 years into the current term. Will this happen we are awaiting for the change by end of 2012 or early 2013.

What was heard was that Taib threaten to pull Sarawak out of Malaysia if Federal Government continue to undermined the Government and politics within Sarawak. Subsequently, Najib left Taib alone and do not say a word about Taib’s retirement.

Federal Government response

In Sabah, Dr. Jeffery Kitinggan used the STAR party to agitate for Sabah rights as agreed through the 20 points agreement signed before the formation of Malaysia. The document is signed under United Nation Treaty supervision.

In Sarawak, the spirit of anti- Malaya due to its colonizing approach is rising. Sarawak today is being colonize in all aspects, education, commerce, religion, politics, social structure and even government through BN.

Malaya took the wealth of Sarawak and gave back “crumps” as development fund. Malaya take all the important Ministry, took all the important post in the civil service, dismantle Sarawak Ranger and install Malay regiment.

Just yesterday, the Army threaten Sabah Sarawak by proposing to put in another Division of Army in Sabah and Brigade strength in Sarawak. This army is not to guard the security of Sarawak / Sabah as there is no external threat but more to ensure that the Federal Government can put down any of Sarawak intention to leave Malaysia.

In Sarawak, many of us sleep through this new development because as usual we do not want to pay attention to what Federal Government is doing to Sarawak. By the time this event of a brigade being placed in Sarawak and the Brigade start to take action then we find out that we are being pro-actively subdued by force in Sarawak.

Conclusion

The Federal Government will not change its approach in dealing with Sarawak. The revenue from oil and gas for that matter contributed to 40% of Malaysia’s income and the main source of corrupt money for UMNO leaders. The BN supporters in Sarawak thought that UMNO really care for Sarawak. The answer is NO, Sarawak will continue to be poor. If the Federal government response by giving Sarawak more development fund, then Taib and his political cronies will take it to keep.

The people of Sarawak are now being squeeze between a hard surface and granite rock. Dayak poverty is good as a source of BN support. Sarawak being poor is reason enough that the Federal Government think that they know what is best for Sarawak and they will continue not to hand back Sarawak oil and gas wealth to Sarawak.

In the coming PRU 13, when you vote for BN you are voting for continued poverty of Sarawak and to allow our oil and gas money to be in the hand of UMNO / BN.

UBAH meh! Change WE Must.

Pemuda-pemudi Semua Marilah, Bangunlah Bersatu Semua...

Peranan pemerintah sangat kuat.

Umumnya negara memperolehi kebenaran politik berdasarkan penyertaan aktif rakyatnya.

Ketiadaan peluang pekerjaan menyebabkan mereka hilang arah tuju selepas tamat belajar.

Separation, not Pakatan Rakyat, is the answer for Sabah and Sarawak - Daniel John Jambun

Constitutional lawyer Aziz Bari is barking up the wrong tree on Sabah and Sarawak re-thinking the idea of Malaysia after 50 years. Professor James Chin is also wrong to label separation attempts in Sabah and Sarawak as treason.

When the two Borneo nations were dragged into the Federation with Malaya, the Conference of Rulers, the Sultans, the states in Malaya were not consulted.

Why must Sabah, Sarawak now go through the Conference of Rulers now that they want to stand on their own two feet? Also, the states of Malaya were not consulted whether they wanted to be in a new Federation with Sabah and Sarawak.

There was no referendum either before Sabah and Sarawak were dragged by the Malayans and British into Federation with Malaya in 1963.

The principles which support Sabah and Sarawak going their own way can be found in the Western Sahara Case Advisory Opinion ICJ Reports (1975) 12.

The inicia include (a) a unique cultural or ethic group; (b) a defined geographic area; (c) the will to emerge as a free state; (d) the will to self-determine governance independently; (e) attempts to assert the aforesaid wills.

A reading of this case is a good start for the client as well as the Declaration on the Granting of Independence to Colonial Territories and Peoples, General Assembly Resolution (XV) of December 14, 1960 GAOR, 15th Sess, Supp 16 at p 66.

Whether it’s easy or otherwise for Sabah and Sarawak to leave the Federation is beside the point.

We have to consider the exact nature and actual circumstances surrounding the British departure from Sabah and Sarawak in the wake of the independence of these two countries on 31 August, 1963 and 22 July, 1963 respectively.

The disturbing contents of declassified British colonial documents make it clear that the British were convinced that Malaya would colonise Sabah and Sarawak after their departure.

If so, these revelations and facts clearly demonstrate that the UK Government abandoned Sabah and Sarawak, inadvertently or otherwise, to Malayan colonialism on/or before 16 September, 1963.

The issue of colonisation arises in Borneo because Malaysia was not properly set up by the British Government in particular and the UN in general.

In the case of Brunei, originally included in the Malaysia concept, it had the choice of not choosing to join in the formation of Malaysia.

Brunei was able to wait for its independence until 1984. It again rejected the Malaysia idea when the Malaysian government approached them on the matter after independence.

Why didn’t the UN intervene in Malaya's occupation of Sabah and Sarawak as it did for example in the case of Indonesia's occupation of Timor Leste?

The people of Sabah and Sarawak, out of ignorance, did not press their case at the UN and at the UN Security Council.

If the Philippines/Sulu were to march into Sabah, for example, the UN will not recognise it even if the people don't protest because Putrajaya will protest.

Re: 16 September, 1963, who protested except Indonesia and the Philippines?
The British disguised it as a coming together of parts of the Empire in the wake of decolonisation although they knew Malaya would colonise Sabah and Sarawak after they left.

It was actually Singapore and Malaya getting together in the wake of the occupation of Sabah and Sarawak by the latter to "facilitate" the Singapore-Malaya merger.

Malaya ostensibly would not "agree" to the merger unless Sabah and Sarawak were part of the 1963 Federation to offset the large Chinese population in Singapore.

After Malaya got Sabah and Sarawak, it kicked out Singapore from the Federation two years later. The Borneo nations were not allowed to leave.

The 50th year of Malaya in Sabah and Sarawak via Malaysia was a moment in history.

The true history behind the so-called Malaysia should be told.

There being no compliance on the Malaysia Agreement stems from the fact that there was no proper decolonisation in Borneo, Malaysia if any was not set up properly, and what we have in fact is Malayan colonisation – despite Tunku's public assurances – replacing British colonisation.

Tunku used the so-called Singapore-Malaysia merger through Malaysia in 1963, with Borneo being the facilitator, as an excuse to get Sabah and Sarawak as colonies.

Having got his hands on the two Borneo nations, he lost no time within two years to kick out Singapore to pave the way for apartheid a la Ketuanan Melayu/Ketuanan Islam.

Why did the British force the Rajah of Sarawak to cede his Kingdom to the colonial office in London and "buy" Sabah for 1.2 million pounds from the British North Borneo Company, both in the wake of World War II, if not to unwittingly or otherwise myopically facilitate Malayan colonisation in shouldering the defence burden in the interests of Britain's Commercial Empire in Borneo.

Fifty years after Sabah and Sarawak found themselves in Federation with Malaya on the other side of the South China Sea, the question that arises is the real name of this Federation.

Article 1 of the Federal Constitution states that the Federation will be known in Malay and English as Malaysia.

Article 160 of the Federal Constitution however defines Federation as that set up by the Federation of Malaya Agreement 1957.

Wither the Malaysia Agreement 1963!

Article 2 further states that Sabah and Sarawak are the 12th and 13th states in the Federation. The first 11 states are the States of Malaya. So, it cannot be suddenly said that the 12th and 13th states are states in Malaysia.

This means the Federation of Malaysia 1963 does not exist.

What exists is the Federation of Malaya 1957 masquerading as the Federation of Malaysia 1963.

PKR is taking the stand that it’s better for Sabah and Sarawak to vote BN out rather than secede from the Federation.

The fact is that the people of Sabah, Sarawak and Malaya have long lost their sovereignty to an apartheid-style set up in Putrajaya.

As in Thailand, it's not possible to change the government through the electoral system because of this loss of sovereignty. The Government lacks legitimacy and it will get away with it if the people just keep quiet.

The present government in Putrajaya must be forced by the UN Security Council to step down and an interim government should be set up to reform the electoral process and hold free and fair elections. – February 17, 2014.

Report of the Commission of Enquiry on Immigrants in Sabah

It seem that the current ruling government of Sabah and Federal trying to fool Sabahan again about the disgusting IC Project that was done in Sabah. In their report, they put the blame on the officer in-charge for the registration and also clearly state that it was believed that it done by groups of syndicate in Sabah.
